PLEASE READ THESE TERMS, BY USING HAPPYGRASSHOPPER.COM YOU AGREE TO THESE TERMS AND THE HAPPY GRASSHOPPER.COM PRIVACY POLICY. THESE TERMS AND THE PRIVACY POLICY MIGHT HAVE CHANGED SINCE YOUR LAST VISIT.

TERMS: 3.2. Money Back Guarantee.

(a) The Money Back Guarantee referred to in this Section 3.2 is available only during your first Fixed-Term Subscription of one year or greater in length (the “Eligible Subscription”). Subject to section 3.2(b), if:
(i) you pay all program fees and costs during the Eligible Subscription; and
(ii) you did not, by the expiration of the Eligible Subscription, generate as Gross Commission Income (GCI) from new (i.e. initiated after the Start Date) closed and pending Transactions an amount equal to or greater than 2X the amount of the fees paid or payable by you to Happy Grasshopper for your Eligible Subscription (those fees, the “Eligible Subscription Fees”), then shortly after the expiration of the Eligible Subscription, Happy Grasshopper will refund to you the Eligible Subscription Fees (“Money Back Guarantee”).
(b)Your eligibility to receive The Money Back Guarantee is subject to the following:
(i) During your first 30 days, you must either upload a list or lists of contacts from sources such as your phone, email, MLS, CRM, lead sources, and social media accounts OR you can share temporary login credentials with your Happy Grasshopper Success Coach and we will help export and import them for you;
(ii) you must attend all scheduled onboarding sessions during the first 30 days, including: (1) the Initial Coaching Call; (2) Writer Interview and/or Content Review; (3) the Launch Call;
(iii) you must review and provide feedback for any custom content within 7 days of being notified it is ready for your review;
(iv) you must complete your pre-writer interview questionnaire prior to being interviewed;
(v) you must be on time and prepared for all appointments; if you cannot keep an appointment, you will provide a minimum of 24 hours notice of your change in schedule;
(vi) you must authorize delivery of automated messaging via email, SMS/MMS, and ringless voicemail for the following cohorts at the following schedule: (1) Contacts categorized as Past Clients and Sphere of Influence shall receive 17 emails per year, 12 texts per year, 12 ringless voicemails per year, including messaging for birthdays, transaction anniversaries, quarterly lead harvesting messages and 6 holidays of your choice; (2) Contacts categorized as leads shall receive content in 3 phases: (i) Acknowledgement (ii) Positioning and (iii) Nurturing, the frequency and duration of which shall be determined by Happy Grasshopper;
(vii) you must allow Happy Grasshopper to analyze your existing lead distribution and lead nurturing methodologies, and to implement any improvements we recommend;
(viii) you must notify us of any material positive or negative changes in your business, and allow us to adjust your messaging strategies accordingly;
(ix) you must connect with your Success Coach monthly to work through any obstacles; and
(xiv) you must not cancel your Subscription prior to the expiration of the Eligible Subscription.
(xv) you must update your Pipeline Document and share with your Success Coach monthly. The Pipeline Document is a shared Google Sheet used to keep track of your pending and closed transactions.
(c) If you do qualify for the money back guarantee and accept it, you will no longer be permitted to use any of the content created for you by Happy Grasshopper. (i) The total amount refunded cannot exceed the total amount you paid.
