At Happy Grasshopper we are committed to safeguarding your information from any unauthorized use. Please be aware, however, that our privacy policy does not apply to any of the external sites you may visit from the links contained on any of our pages. We encourage visitors to be aware when they leave HappyGrasshopper.com and to read the privacy statements of sites that collect personally identifiable information.

The policy outlined below only applies to HappyGrasshopper.com unless otherwise stated. Reference to the “Product” refers to any and all of Happy Grasshopper’s services and/or products including, but not limited to, its email marketing services.

What kinds of information do you retain?

If you choose to use our services, we will collect the following:

  • When you access our website
  • The exact pages you visit
  • The online address of the site you used to arrive at our site

We will also retain what are known as “cookies.” These are exclusive text files that track information regarding how our visitors use our site. The files monitor any personal preferences you entered when you first accessed HappyGrasshopper.com. This prevents you from having to re-enter the same details every time you visit.

How do we safeguard your information?

Happy Grasshopper remains committed to protecting your personal information and the information you share with us in your account including your credit card data, contact data, and signature information, and personal contact database using every available means. This includes:

  • Investigating the criminal background of any employees with a thorough screening process
  • Having employees sign a confidentiality agreement
  • Storing all information on secure servers maintained and managed by Rackspace.com

Who will have access to my personal information?

  • We may provide our customer service employees with some of your information to improve the level of service we can offer you.
  • We may share your information with our technical department in order for employees to perform required maintenance work or verify the integrity of our computer systems.
  • We may disclose your information if we suspect that you are involved in any type of illegal or fraudulent activity or if we believe you are threatening the physical safety of another individual.
  • We may provide your information to an authorized court upon receipt of a formal judicial request.
  • We may share your information if you violate any of the terms of use we have outlined on our site.
  • We will provide your information in the event new owners purchase HappyGrasshopper. Also, in the event Happy Grasshopper sells a line of business or transfers substantially all of its assets, your information might be a transferred asset.

Will I be able to edit or delete any information from your site?

Yes, you can choose to remove any information except contacts who have requested to opt-out from our database. We retain the opt-out requests in order to comply with the CanSpam Act. If you delete important data such as your email address or contact information, it will limit our ability to provide you with the best customer service.

Can I disable the cookies on your site?

Yes, you can choose to disable the cookies option on your computer. You may also decide to delete your name or email address from our email distribution lists.

What is your policy with regard to blog postings and social media?

Happy Grasshopper allows you to post comments on our blog and to communicate with us through a variety of electronic and/or social media means. It is important for you to remember that you are not required to reveal your identity to others. If you do reveal your identity to any third parties through such means you do so at your own risk. Happy Grasshopper.com is not responsible for the privacy or security of any information, personal or otherwise,that you choose to communicate or exchange in this way. Further, any information you do disclose you must have the right to disclose and its disclosure must not violate any confidentiality requirements or intellectual property rights.

Also, in the event you submit any statement regarding your use of the Product (a “Testimonial”) and/or in the event you submit a photograph (a “Photo”) in conjunction with any such statement, both the Testimonial and Photo may be used in connection with publicizing Happy Grasshopper, including, but not limited to, the Product. Such use shall be solely at the discretion of Happy Grasshopper.

You hereby irrevocably authorize Happy Grasshopper to copy, exhibit, publish and distribute the Testimonial and/or Photo in any manner whatsoever, through any medium whatsoever, whether in existence now or to come into existence hereinafter, including, but not limited to, online, print, multimedia, film and video, for the purpose of promoting Happy Grasshopper throughout the world and universe. You further understand and agree that Happy Grasshopper may edit and/or modify your submission as it deems appropriate. You agree that you will make no monetary or other claim against Happy Grasshopper, its parent, subsidiaries or affiliates, members, officers, agents and representatives, for the use of, or in relation to, the use of the Testimonial and/or Photo. In addition, you hereby waive any right to inspect or approve the finished product, including, but not limited to, written copy, wherein your photo appears.

You understand and agree that you shall have neither the right to inspect or approve any finished product that includes the Testimonial and/or Photo nor any right to inspect or approve any modified or edited Testimonial and/or Photo.

You hereby understand and acknowledge that once released by Happy Grasshopper your image may be used by a third party and that Happy Grasshopper will have no control over such use by such third party.

You hereby hold harmless and release Happy Grasshopper, its parent, subsidiaries, affiliates, members, officers, agents and representatives, from all claims, demands and causes of action which you, your heirs, representatives, executors, administrators or any other persons acting on my behalf or on behalf of your estate have or may have by reason of this authorization.

You hereby certify and confirm that you at least 18 years of age and the Testimonial was written by you and the Photo submitted, if applicable, is of you and that no other party holds any intellectual property right in such materials and you hereby agree to hold Happy Grasshopper harmless in the event such a claim is brought by a third party(ies). You understand that in the event you are under the age of 18, you shall not submit any Testimonial or Photo as is described hereinabove.

You freely consent to the use of your Testimonial and/or Photo by Happy Grasshopper.

How will I know if this privacy policy changes?

Happy Grasshopper can make changes to this privacy policy at any time, so you should periodically review it to see if an updated version has been posted. Any changes to the HappyGrasshopper.com privacy policy will be posted on the site. In addition, we will make a reasonable attempt to contact all of our clients personally to notify them of the change.

If another company buys or sells Happy Grasshopper, we will also attempt to notify you individually. You can then choose whether you prefer to cancel or maintain your current account.
